Brand Overview

Greenback is an Australian plant-based nutrition brand offering protein bars, powders, and functional snacks. Built around clean, high-quality ingredients, the brand operates in a market that is growing fast — and attracting increasing competition from both domestic and international players.

With an active growth agenda and plans to sell through international retail and online channels, including Amazon, getting the brand protected early and strategically was not just a legal formality. It was a commercial priority.

The Challenge

Greenback was scaling into markets where the health and wellness sector is crowded with similar naming conventions, overlapping brand identities, and well-resourced competitors. A piecemeal approach to trademark protection — filing country by country without a coordinated strategy — would have been slow, costly, and exposed the business to unnecessary risk during a critical growth phase.

The key challenges included:

  • Securing consistent protection across several international markets simultaneously
  • Managing differing examination standards and legal requirements in each jurisdiction
  • Aligning the filing programme with the client’s commercial rollout and distribution timeline
  • Reducing the risk of objections, delays, or gaps in coverage that could disrupt the business

Our Approach

We developed a coordinated international filing strategy built around the Madrid System — a cost-effective mechanism that allows a trademark owner to seek protection in multiple countries through a single centralised application, rather than managing separate national filings.

Our work included:

  • Conducting clearance searches to assess registrability in each target market before filing
  • Advising on country selection and filing strategy based on commercial priorities and risk
  • Filing an International Registration under the Madrid Protocol, designating 10 countries
  • Managing prosecution across all designated jurisdictions, including responding to provisional refusals where they arose
  • Engaging local counsel in specific markets to resolve jurisdiction-specific legal issues

This approach gave the client a single point of management for their global portfolio, while still addressing the specific legal requirements in each country.

The Outcome

Greenback secured trademark registrations across the majority of its designated jurisdictions, providing a solid and commercially useful foundation for international growth.

Key outcomes included:

  • Exclusive trademark rights in key international markets
  • A streamlined, cost-effective global protection structure managed through a single registration
  • Centralised portfolio management, giving the client clear visibility over their IP position
  • Transparent advice on jurisdictions where protection was not achievable, with clear options to manage that risk
  • Eligibility to enrol in Amazon Brand Registry — giving Greenback greater control over their product listings, brand presentation, and enforcement on the platform

The result was a brand that could scale internationally with confidence, backed by a protection framework built around the business’s actual commercial needs rather than a standard filing checklist.
